Funny how Nascar(Nextel) didn't say any thing to Jeff Burton about his Cingular stickers after AT+T sold their wireless service to Cingular making them bigger than Nextel. But when AT+T buys back their service and Cingular's they get upset. Nascar think tank is starting to act like F1 think tank. It's already getting to the point were the same three teams win week in and week out.

I believe "Cingular" was grandfathered in from Winston Cup.

I'm curious, how can AT&T win this suit? Doesn't NASCAR have the right to choose who they're affiliated with? For example, cigarette companies can't sponsor cars and that's just the way it is. Although admittedly, I could never figure out why it was bad to have tabacco companies advertise in a motor sport and yet it's ok to let liquor and beer companies do so? How many folks have died or been killed as a result of smoking and driving? but that's another discussion for another time.

Back to the topic at hand. If it is a clause in the contract NASCAR has with NEXTEL (their primary corporate sponsor) then where is the legal claim for this lawsuit? How can NASCAR be forced to allow AT&T in which ultimately would lead to a breech of contract suit with NEXTEL?

Talk about damned if you do and damned if you don't.....

It's not a matter of NASCAR deciding with whom THEY want to be associated but more them telling Burton whose stickers he can put on his car. The are basically telling him who he can have sponsor him. If it were the case, like tobacco products where they ban them all but this is a case where they are singling out just one carrier.

I am more surprised that Nascar has control over individual car ads. I always thought those were independent deals made by the team owner. Does this happen in any other sports?

Other than boxing (IMO THE "dirtiest" sport there is) I doubt any teams in any league could be sponsored by a casino....well other than wherever Rose could've been managing.....

I don't think NEXTEL is telling AT&T they can't sponsor, I'm betting that's it's all about competing with them in their own field...sponsor away AT&T, just don't advertise on the car or the suits. I'd also be willing to bet that NEXTEL has that in THIER contract with NASCAR.
