I think they would have had a huge court battle with the MLBPA (if they can do that to him, what could they do to the next guy) had they tried to push for a lifetime ban.

Remember, he's right at 40 by the start of the 2015 season, so....

Now, the flip side is...since they made this a drug only deal, he can play while he appeals. And that, to me, is a joke. I don't know as an organization if there's something the Yankees could do about that w/o raising the ire of the MLBPA..or if they'd want to do it, but with the league only talking drugs, AHole already gets a reprieve from having potentially illegal, certainly immoral activity brought up (evidence tampering, paying bribes on the legal side...encouraging young players to follow his lead in taking these PEDs on the moral side)

If I'm Jeter and Girardi I'm not so matter of factly talking about welcoming him back into the lineup.

I heard the beginning of his press conference in Chicago, and when he said the last 7 months have been a nightmare, I threw up in my mouth more than a little bit. Surgery, OK.. but the PED stuff is self-inflicted. He could have come all the way clean before and chose not to..so boohoo

and they shouldn't be, Rich....he'll now likely impose himself on the team and its fans (and its teams opponents) for the rest of the season, just to attempt to persuade the arbitrator that he's somehow been wronged

meanwhile, he'll play even while suspended because the arbitrator isn't likely to rule until the offseason....and the others will get a vacation (albeit unpaid) for the rest of the season, but still somehow be eligible to step right back into the lineup if their team makes the playoffs

And yeah, jbrune...he calls the press conference after getting suspended under the league's drug policy, then not once but twice (I hear) basically said 'this isn't the forum to discuss that' when asked about it....kinda like making an appointment to see a divorce lawyer then telling the lawyer you don't want to talk about a divorce

I'm all for 1st time offenders being banned for a year, then second time offenders get the lifer.

That would be at least a step in the right direction in an attempt to deter the cheaters.

But until the league (with the MLBPA's blessing) can close up all the loopholes that cheaters have used in the past to dodge a positive test result, it still won't mean much...

When a high profile player like Braun can essentially dodge his first positive test due to someone leaving his sealed sample on his desk for a day, the process is still very flawed.

Testing positive for PED's in MLB is like getting a DUI in today's society ... those that can afford a good lawyer will walk with no punishment while the "common folk" must pay the full price....
